Mary McCord is now serving as a Visiting Professor of Law at Georgetown University Law Center in addition to her role as Executive Director of the Institute for Constitutional Advocacy and Protection (ICAP). At the Institute for Constitutional Advocacy and Protection, McCord is the leader of a team that brings constitutional impact litigation before all levels of federal and state courts. These cases cover a wide range of topics, such as the rights of the First Amendment, immigration, and the reform of the criminal justice system, as well as the fight against the rise of private paramilitaries.
During the years of 2014 and 2016, McCord held the position of Senior Deputy Assistant Attorney General for National Security in the United States Department of Justice. From 2014 to 2016, he served as the Acting Assistant Attorney General for National Security.
Before that, McCord worked for the United States Attorney’s Office for the District of Columbia for over 20 years as an Assistant United States Attorney. She worked as a Deputy Chief in the Appellate Division, where she was in charge of supervising and arguing hundreds of cases in the U.S. and District of Columbia Courts of Appeals, as well as Chief of the Criminal Division, where she was in charge of supervising all criminal prosecutions in federal district court. Among her other positions, she also served as a Deputy Chief in the Appellate Division.
McCord is an amicus curiae for the Foreign Intelligence Surveillance Court as well as the Foreign Intelligence Surveillance Court of Review. This designation was given to McCord by statute. Following the attack on the United States Capitol on January 6, 2021, Nancy Pelosi appointed McCord to serve as legal counsel for the United States House of Representatives Task Force 1-6 Capitol Security Review. McCord was a member of this task force. McCord was also a member of the Columbus Police After Action Review Team, which was tasked with assessing how the Columbus Police Department in Ohio responded to the demonstrations that occurred during the summer of 2020.
Domestic terrorism, unlawful militia activities, public safety, and the rule of law are some of the topics that McCord has covered in his writing for publications such as the Washington Post, New York Times, Wall Street Journal, Los Angeles Times, The Atlantic, Slate, Lawfare, and Just Security. She has made appearances on a variety of networks including NPR, PBS, CNN, MSNBC, and ABC, among others.
In 2018, the Virginia Trial Lawyers’ Association presented McCord with the Oliver White Hill Courageous Advocate Award in recognition of her work with the Institute for Civil and Human Rights (ICAP) to litigate against white supremacists and private militias that attended the Unite the Right rally in Charlottesville, Virginia, in 2017. The rally took place in 2017.
After receiving his legal degree from Georgetown University Law School, McCord worked for the Honorable Thomas Hogan of the United States District Court for the District of Columbia as a law clerk.
